Promocial Terms of Service

These terms apply to the Promocial app and to the Promocial website at promocial.ai, both operated by Promocial.

1. Who we are

"Promocial" ("we", "us") plans, produces and schedules short promotional videos for small businesses, from the United Kingdom. These terms are governed by the laws of England and Wales, whose courts have exclusive jurisdiction. Contact: hello@promocial.ai.

2. What the service does

Promocial plans, produces and schedules short videos for your business and, with your permission, publishes them to your own TikTok account. You approve every video before it is posted. We are not affiliated with, endorsed by, or a partner of TikTok or any other platform.

3. Your account and your content

• You keep ownership of your business information, your footage and the videos we produce for you.
• You grant us permission to use that material only to produce and publish videos for you.
• You are responsible for the accuracy of what you tell us about your business, including prices.
• You connect your own channel account and may disconnect it at any time.

4. What you must not do

• Use the service for anything unlawful, or for a business you do not own or represent.
• Supply material you do not have the right to use.
• Ask for content that is misleading, defamatory, or breaches a platform's own rules.

5. Publishing and platform rules

Publishing depends on third-party platforms and their terms, availability and review processes. We cannot guarantee that a platform will accept, retain or distribute any particular video, and platform decisions are outside our control.

6. Payment

Paid plans bill monthly via Stripe. What is included, and at what price, is whatever is shown at the time you subscribe; we do not change the terms of a subscription you have already bought without telling you. You can cancel at any time and keep everything already produced for you. No pricing is published yet and no charges are taken.

7. Ending the agreement

You may stop using the service at any time. We may suspend an account that breaches these terms. On ending, we stop producing and publishing and delete your data as described in the Privacy Policy.

8. Liability

The service is provided "as is". To the maximum extent permitted by law, our total liability under these terms is capped at the fees you paid in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

9. Changes

We will tell you by email before any material change to these terms takes effect.
